how do I stand legally?

    thats what really gets to me the kids walk passed everyday to school and the gates are proped shut with a brick! I am realyy worried

    I would keep phoning the dog wardens until I got a response and would also log it with the police. I think it's worth pursuing especially since this has happened several times.
    I hope you manage to get something sorted.

    I will do but the dogs gone into hiding now because they know i'm furious

    I could explode though as my lovely neighbour who as a totally gorgous Welsh springer Henry told me that the dog warden called to see her about the complaints they had had about their vicious dog:eek:
    Luckily when she told me they had realised he had got the wrong house and just laughed at him. he got embarssed when he realised his mistake and left quickly.
    The Bl**dy silly man went to the wrong house wrong dog. Can't tell the difference between a springer and a husky...there is no hope.
    I rang his boss and have put in a complaint about him
    He's still not rung me!

    the husky death match continues I'm really just one fence away from A&E

    That is absolutely appalling. I can only suggest catching some of the behavior on video. At least that may help if you ever need to go to court.

    I agree with Karen to try and capture the behaviour on video and perhaps make a complaint to the police. You've complained to the Council and they have effectively done nothing and you need to protect yourself and your dogs.

    I thought with this new legislation around the Dangerous Dogs Act, that if you even FEEL threatened by a dog, even if it is on its owner's property, that you have grounds for legal action? MaccieD is right - go to the police.

    He finally rung full of apologies and has taken the complaint. He's going to see them this week and also because of the seriousness of the situation he will also be giving them a written warning outline their responsibilties and how seriously him and the police will take this. If the dog does get into my garden and does anythingor is even scares to me they will prosecute and it can involve a jail sentence. He has also told me to phone the police or him if it does get into the garden and outlined what I need to do. I have also told him about my welfare concerns and he is going to try to see the dog.
    Don't know if it will help but at least he is aware. I had made a complaint last year too and he took it a lot more seriously this time because of that and what my neighbour had told him. fingers crossed. The strange thing is since the street incident I've only heard the dog bark at us once or twice and not seen it at all. They are hiding it.

    Hopefully just want to beable to use the garden for me and the dogs its just too dangerous at the moment

    Well I am very glad for you, but I would still go to the police. My son is a criminal solicitor and he said you should too. You should be able to enjoy your own garden without fear of being attacked. Let us know what happens.

    thanks everyone i'm just hoping the added pressure will make them get rid of the dog, they hardly walk it anymore and the kids have lost interest. I know its sad for the poor dog but its got to the point were i have little sympathy for it or them

    I hope you feel safer soon. I feel so very, very sorry for the dog too - I'm glad you highlighted the welfare aspects of this to the dog warden.

    This is such a sad story, I really hope you can get some closure soon that brings peace back to you and your neighbours. I feel sorry for the dog, some people really, really should not be allowed them :(

    Some progress at last but you and the dogs should feel free to enjoy your garden without worrying about the dog next door. Hope you have a resolution soon.

    poor thing has the worst life Julie T no company n his own all day in the garden whatever the weather, it so hard to watch, I really hate it. No exercise so his muscles are really deterioting and he looks older than he is. He spends his time killing hedgehogs and pigeons and is looking very poor physically. I know its not his fault he's a nightmare I do feel so sorry for him, just don't want to get me and my dogs in trouble with him and badly injured . He's grabbed Doug round the next 3 times now and Doug didn't hear or see him coming he could kill him next time. Its terrible really they don't deserve him and in the right hands i'm sure he would be fine. Hard to cope with on a lot of levels but he could have a happy life with someone who loves of dogs. Horrible

    well the dog warden has been to speak to them and he has also issued them with a written notice. If the dog does anything else he will bring legal procedings against them. Also if it comes into my garden I am to ring him or the police to come and seize the dog.
    Strangely its not barked at my dogs and is being kept in. I don't know how long its going to last but I'm just enjoying the peace and the dogs are enjoying their garden. I just can't believe them they knew what to do and how much it was affecting me and my dogs but did not care a dame until I got the warden involved. Nasty mean people.
    The warden was also going to see the dog as he felt there might be a welfare problem too.
